Terms and conditions
Terms of purchase are not great fun but we need to have it detailed. However, our philosophy is that if you have to read our terms and conditions then we have failed. If there is something you are wondering about or are not satisfied with, contact us and we should probably be able to find a solution.
1. Terms of purchase
Ordered products remain the property of Livsyta until they are paid for in full.
When we have manufactured your product, it will be sent from our joinery in Hälsingland. Changes and additions must be made before your order begins to be manufactured and shipped from us. If you discover any errors on your order, it is therefore important that you contact us immediately to change this.
In the event of obvious errors (e.g. wrong price, printing error, etc.) we reserve the right to correct the error afterwards. If you are not satisfied with our correction, you of course have the right to cancel your order. We also reserve the right not to fulfill an order.
2. Prices and methods of payment
All prices are stated including VAT within the EU. After an order has been confirmed, the price can only be changed due to circumstances beyond our control (e.g. war, natural disasters, etc.) and in the event of obvious inaccuracies in the stated price. We reserve the right to write errors in terms of price.
3. Manufacturing and delivery information
Livsyta sends the outdoor kitchen in ready-made modules to the customer's home and offers to assemble the kitchen on site for a fee. Assembly can in some cases be done by partners to Livsyta. We reserve the right to charge the customer additional shipping for deliveries beyond normal. If the customer does not receive/redeem the shipping, the customer is charged for return shipping and administration.
You will receive notification of any deviations from the normal production or delivery time or the information on the website when we confirm your order, or later via a separate email. You then of course have the right to cancel or change your order. Should any of the products you ordered have a significantly longer delivery time than the other products in your order, we can in some cases split your order.
4. Transport damage and wrong dispatch
The carrier's responsibility as a carrier begins when the carrier, through authorized personnel, has taken over the shipment for forwarding, and ends when the shipment at the place of destination has been handed over to the recipient or placed at his disposal. Visible damage, reduction or loss must be reported immediately upon receipt of the goods and recorded in the certified copy of the transport document or other document. Recipients of a shipment are obliged to check immediately upon receipt whether the item has any damage hidden by the packaging. Hidden damage must be reported to the carrier as soon as possible, but no later than seven (7) calendar days from receipt of the shipment. We recommend that you notify us as soon as possible of an order that has been dispatched incorrectly. A new correct delivery will then be made to you as soon as possible at no extra cost.
Force Majeure - Livsyta AB is not responsible for damage or delay due to law, government action, mobilization, war event, seizure, currency restriction, system error, error or restrictions in deliveries from subcontractors, strike, lockout, boycott, blockade or other similar circumstance which either hinders or complicates Livsytas's fulfillment to such an extent that it can only take place at an abnormally high cost.
5. Warranty and complaint
We strive for you as a customer to feel secure when you shop with us. That is why we offer very favorable warranty terms. The warranty applies to malfunctions that occur during the warranty period. The warranty does not apply to errors that occur during or after the product's function and appearance have been changed, such as rebuilding, upgrading or other configuration of the product. We generally give you a 10-year warranty on our outdoor kitchens, apart from certain wear parts. Before a warranty repair or warranty exchange can be approved, we need to examine the product. In the event that the product is not subject to a warranty fault, but a so-called handling fault (includes incorrectly set product, damage due to negligence, etc.), we have the right to charge you for the examination cost. Shipping costs and handling fees apply.
6. Right of withdrawal and open purchase
We offer you a 14-day right of withdrawal from the time you receive the item, provided the item is unused. The right of withdrawal does not apply to goods built according to personal instructions. To exercise the right of withdrawal, we ask that you notify us as soon as you know that you want to cancel your purchase. Remember that you are responsible if the product is damaged when it is shipped back to us, so make sure the product is well packed. In cases where accessories are missing or physical damage is found, we reserve the right to charge a fee to restore the item to functional condition. When using your right of withdrawal, you as the customer are responsible for the return shipping (keep in mind that the return costs can be high, upwards 1,000 EUR.
Other costs, such as the cost of the item and shipping from us to you will be refunded. A refund/credit takes place primarily to the original payment method, which normally takes place within 10 working days from the time we receive and approve your return. Refunds can only be made to the same card that was used at the time of purchase.
If you want to exercise the right of withdrawal, you must send a clear message about your decision to withdraw from the agreement to hello@livsyta.com
